This Fair Use Policy outlines the terms under which you may use Konaga services.
1. Website and Application Lease Agreement
We aim to ensure your website or application runs smoothly, but we can’t guarantee it will be error-free. We aren’t responsible for any
losses due to software issues or changes made by you or a third party.
We also aren't liable for missed deadlines or any related costs or earnings loss.
2. Website Updates and Amendments
Once your website is live, you can request unlimited minor updates like text changes,
image additions, or adjustments to contact forms. However, layout changes, graphic design,
or adding extra pages may incur additional fees. All updates depend on receiving content
from you. We do provide copywriting and stock images, these services can be requested for a fee.
3. Payment Terms
Payments are made monthly via bank transfer, starting one month after the contract is signed.
If a payment is missed, services may be suspended until full payment is made.
4. Contract Terms
The design fee, monthly cost, and contract duration are specified in your signed agreement. If you cancel early, you'll need to pay
the remaining balance for the full contract term. After the contract ends, it automatically renews monthly
unless you give one month’s notice to terminate.
5. Hosting
Hosting is only available for websites we maintain, starting at £80/month. Email accounts and Google Analytics
setup are available separately. We are not responsible for search engine indexing issues.
6. Ownership - Rental
The website or database remains our property during the contract. After the contract term, you can choose
to continue hosting for an additional fee. If you cancel, only your data can be exported, and the website code for an additional fee.
7. Domain Name Registration
Domain names are not included in rental packages. You are responsible for obtaining and
managing them, including DNS settings. Assistance is available for an additional fee.
8. Browser Compatibility
We strive to support major browsers but can’t guarantee full compatibility. Internet Explorer
versions older than 11 are no longer supported, and we advise using updated browsers for security reasons.
9. Materials Provided by You
You are responsible for ensuring any materials you provide don’t violate copyright. We may refuse to
use content that includes adult themes, illegal downloads, violence, or discriminatory content.
10. SEO (Search Engine Optimisation)
Basic SEO tasks like title tags and sitemaps are included with website launch. Advanced SEO services
like content writing and keyword research are available for a fee. We can’t guarantee any specific search engine ranking.
11. Annual Web Hosting
Our hosting services are only available for websites we’ve developed. While we aim to keep services up and running, there may be times when
the server goes down for updates or other reasons. We aren’t liable for any downtime or loss of data,
and no compensation will be provided. We also don’t take responsibility for losses caused by natural
disasters or other major events like civil unrest, floods, or war.
12. Personal Information
We store basic information about you, such as your name, address, contact details, and the websites we host for you. All your
information remains confidential and will not be shared with third parties. To know more, you can

13. Conditions
By signing up with us, you agree to follow these terms. They apply to all accounts. You can’t host multiple domains on one
account, but subdomains may be used as extensions of the main website. Any domains added to your account must belong to you.
14. Your Responsibility to Backup Content
You’re responsible for backing up your website’s content. We highly recommend you regularly save copies. We aren’t responsible
for any loss of data and can back up your content for an additional fee.
15. Content, Images, and Videos
Your account can only be used for lawful purposes. Any copyright infringement
(such as selling counterfeit goods or unauthorised copying of music, books, or videos) is forbidden. If we suspect infringement, we can suspend or terminate your account. If there’s a legal issue with your content, we may also suspend your account.
If you need us to write content for you, you must check and verify all references and sources.
16. Prohibited Content
The following activities are strictly prohibited:
- Adult material (including pornography or escort services)
- Offensive language
- Pirated software or illegal downloads
- Material that promotes violence or discrimination
17. Business IT Support
We’ll provide the agreed services to you, either on-site or remotely. All service start
and end times are estimates, and we’ll aim to complete work as quickly as possible. In
some cases, we may need you to install remote support software. We may suspend services if
necessary to protect ourselves or others, if you fail to pay, or if required by law.
Maintenance may also require suspension, but we’ll notify you in advance.
18. Data Protection
You must follow all data protection laws, and we both agree that you control the data,
while we process it. We’ll only process personal data to provide services and will keep
your data secure, preventing unauthorised access.
19. Fair Use Policy
- Website Rental (without CMS): Limited to 2 hours of usage per week.
- Website Rental (with CMS): Limited to 2 hours of usage per week.
- Telephone Support: Unlimited.
- Email Account Storage: Limited to 2GB per account.
- Static Website Pages: Maximum of 30 pages.

20. Graphic Design Materials
- Originality - Creative Integrity:
- All graphic design materials produced are intended to be original works. Any use of third-party content, such as images, fonts,
or illustrations, will adhere to the licensing terms provided by the content owner. Konaga will only use free or
appropriately licensed resources, ensuring no infringement on intellectual property rights.
- Use of Copyrighted Material:
- If a client provides copyrighted material for use in the design, it is their responsibility to ensure they have
the proper rights or permissions for use. Konaga will assume that any content provided by the client is legally
permissible for commercial use unless otherwise stated.
- Client-Supplied Content:
- The client is responsible for securing any necessary permissions for the use of logos, trademarks, or other
protected content they wish to include in their materials. Konaga will not be liable for any legal consequences
stemming from unauthorised use of client-supplied content.
- Non-Commercial Use:
- If any design project involves content used under a fair use claim (e.g., for educational or non-commercial
purposes), Konaga will ensure that it meets the necessary criteria under fair use laws. However, for commercial
designs, proper licensing will always be obtained to avoid infringement issues.
- Third-Party Content - Attribution:
- For any designs using third-party content where attribution is required (such as Creative Commons licenses),
Konaga will include appropriate credit to the original creator as required by the terms of use. No unauthorised
reproduction or distribution of third-party materials will be undertaken without explicit permission.
- Ethical Standards:
- Konaga upholds high ethical standards and ensures that all graphic design work respects copyright laws,
ethical guidelines, and creative rights. Clients are advised to provide materials that comply with legal standards to avoid liability.
21. No Contract, Freelance Pricing - Charges
- Working Hours: Monday to Friday, 9:00 am to 5:00 pm.
- Konaga Rates:
- Hourly Rate: £35
- Day Rate: £280
- Out-of-Hours Rate (Call-out/On-call): £20 per hour
- Payments:
- A 50% deposit may be required before starting work (as stated on your invoice)
- Full payment is due once you receive the invoice
- Data Backup:
- You are responsible for backing up your own data.
- Website Platforms:
- We only work on website platforms agreed upon in advance
- We won’t host websites that are not under contract with us
